Introduced back in 2006 and made compulsory 15 years later, the DPE - short for Energy Performance Diagnosis - is a tool that gauges the energy efficiency of dwellings or buildings. It assesses energy consumption and its impact on greenhouse gas emissions[3]. Over the years, some companies have resorted to deceptive practices to capitalize on their expertise in this area.

So, as reported by 20minutes, a hapless couple found themselves ensnared by a remote DPE scam in January of last year[4]. In their haste to validate their dream home purchase on the Morbihan coast, Rodrigue and Louise were taken in by a seller who had failed to carry out a proper DPE. And at the notary's office, this tiny detail didn't go unnoticed...

It turns out, the energy diagnosis in question was dated five days prior to the transaction[4]. But during that time, the couple had already spent 24 hours in the property. When they reached out to the owner, he claimed it had been done remotely - a practice that he claimed was becoming commonplace[4]. However, as the law stipulates, it's not legal for a DPE to be performed remotely.

"It's a blunder on the part of the notary," commented Juliette Mel, a real estate law specialist at M2j law firm[4]. The 3CL-DPE2021 standard explicitly states that an on-site diagnosis is required. Given that this involves checking insulation, heating, ventilation, and measuring voltage, it's clear that such assessments can't be conducted remotely[4]. If a DPE doesn't comply with the standards or is outright fabricated, the sale can be nullified if the buyers contest it[4]. Indeed, this very situation unfolded for Rodrigue and Louise.
