Kazakhstan's Ministry of Justice Recovers 279M Tenge After Uncovering Serious Enforcement Violations
The Enforcement Committee of Kazakhstan's Ministry of Justice has uncovered serious violations in proceedings worth 4.4 billion tenge. The Committee, committed to transparency and protecting parties' rights, has taken action to address these issues.
Investigations revealed that 699 private enforcement officers were held accountable for disciplinary offenses. Notably, a bailiff in Taldykorgan was found to have embezzled child support, while two CSEs in Nur-Sultan squandered millions of tenge on gambling. In total, 42,000 proceedings were affected by unjustified delays in fund transfers to claimants.
The Committee recovered approximately 279 million tenge for the state, representing 81% of the identified violations. To prevent future occurrences, the Committee is automating the fund transfer process through the AIS OIP system, similar to internet banking. This move aims to enhance transparency and efficiency.
The primary cause of violations was the incorrect application of the law, with officers unlawfully retaining funds as payment for their services. The Committee's interventions have restored the rights of citizens in 34,000 cases, totaling 2.4 billion tenge.
The Enforcement Committee is working on establishing deadlines for fund transfers as part of the draft law 'On Amending and Supplementing Certain Legislative Acts of the Republic of Kazakhstan on Improving Enforcement Proceedings'. By doing so, it aims to strengthen the enforcement process, protect citizens' rights, and ensure transparency in the system.
