In a landmark ruling, a 51-year-old entrepreneur from Halle (Saale) was sentenced to three years and eight months in prison for withholding and misappropriating wages. The verdict, final as of 30.04.2025, comes after a series of investigations conducted by the Halle (Saale) Financial Control of Undeclared Work and Hauptzollamt Magdeburg.

The entrepreneur, who holds Serbian and Bosnian citizenship, had previously fled abroad to avoid proceedings. The investigations revealed that the convicted person employed workers whose wages were paid under the table and not reported for social security contributions. A total of approximately 1.12 million euros in gross wages were paid in this manner, resulting in the withholding of around 405,000 euros in social security contributions.

The investigations also uncovered that the entrepreneur had multiple prior encounters with the police. This suggests that the entrepreneur had a history of evading legal responsibilities. The entrepreneur initially failed to appear at the start of the main hearing and fled abroad, but was later provisionally arrested in Montenegro based on an arrest warrant.

The defendant made a full confession during the main hearing, admitting to committing 33 offenses of withholding and misappropriating wages. The offenses were committed against multiple workers. However, it's important to note that the defendant's brother, who is the authorized manager of the construction company, was not charged or sentenced in this case.

Wage withholding or misappropriation is a violation of labor laws and can result in penalties imposed by labor courts and possibly criminal prosecution for wage theft or fraud. Employees may file claims to recover unpaid wages, and the business may be required to pay back wages with interest and fines.
