The Current State of Business Tax in NRW

The standard tax rate across municipalities hovers around 450%, but in some places, it's as low as 250%. Wait a minute, you ask, those are two completely different numbers! Yes, dear readers, and the municipalities with the lower rates, namely Monheim and Leverkusen, are about to have some unexpected changes coming their way.
Setting Sights on Tax Evasion
CDU and Greens in NRW joined forces last year to combat existing business tax havens. To do this, they plan to anchor regulations in the municipal finance law making these tax havens unattractive. Besides strengthening their relationship with the municipalities, they aim to identify the true locations of businesses and support them in doing so. The new state authority for combating financial crime in NRW has already started focusing on fighting tax evasion through shell companies in NRW business tax havens.
Addressing Inequality and Promoting Fair Competition
You're probably wondering, "Why are the tax rates in these particular municipalities so low?" Well, it's not all about demonstrating generosity towards businesses. Despite the low tax rate, there's a substantial amount of business tax revenue generated in these business tax havens compared to neighboring municipalities. This practice, referred to as business tax dumping, is not only unfair to neighboring municipalities, but it also encourages the creation of letterbox companies.
Fighting Unfair Tax Competition and Protecting Vulnerable Municipalities
Municipalities on a consolidation path, as well as those that have had to increase their tax rates, are particularly sensitive to the impact of business tax havens. These municipalities are keen for the state to take regulatory measures to prevent aggressive tax competition and protect them from losing revenue due to business tax havens.
"A race to the bottom on business tax rates only leads to a vicious cycle," said Christof Sommer, Managing Director of the Association of Cities and Municipalities in NRW. He added that the increase in the minimum tax rate is the first step towards addressing the financial challenges faced by municipalities in the region.
The Association of Towns and Municipalities in NRW called on the state government earlier this year to put a stop to unfair tax competition from business tax havens and lobby for a comprehensive package of measures at the federal level. The financial and justice authorities of the state were also encouraged to support municipalities in combating illegal tax avoidance.
